All images taken are copyright to Mark Stothard unless pre-agreed and supply of Copyright Release Form and or Model Release Form and Release Series Number.
RIGHT MANAGED (RM) IMAGES
All images are Rights Managed, a license is issued for specific use only, a usage which is affirmed by the client.
We offer to pre-approved business customers 28 days credit terms, (Invoice Factoring), subject to status, account application form must be completed. All new customers must pay in full their first order on commission. We accept payment via BACS and Credit Card. Payment is accepted in £- Sterling, € – Euro’s and $ – US Dollars.
DELIVERY OF IMAGES – PHYSICAL COPIES
This clause sets out our delivery policy where you have placed an Order that has been accepted by us for physical copies of Images to be supplied to you.
Once your Order has been accepted, we will deliver the Images ordered by you to the billing address you give us at the time you place your Order with us.
A signature is required to confirm receipt at the time of delivery.
DELIVERY OF IMAGES – ELECTRONIC COPIES
This clause sets out our delivery policy where you have placed an Order that has been accepted by us for Images to be supplied to you in an electronic format.
Once your Order has been accepted, we will make the Images available for you to download.
It is your responsibility to arrange for the download of the Images and to ensure that your software and/or hardware is compatible with the Images.
RIGHT FOR YOU TO CANCEL (CONSUMER PURCHASES ONLY)
If you have made a Consumer Purchase you may cancel your Order for any Images at any time before the end of the 7th (seventh) Working Day from the date you received the Images:
In order to exercise your right under sub-clause you must notify us of your intention to cancel in writing.
If you have received physical copies of the Images from us before you cancel your Order you must return all of these copies to us at your own cost and risk within 30 (thirty) days of the date of your notice of your intention to cancel. You must also destroy all other copies (including electronic copies) of the Images in your possession and/or control.
The returned physical copies of the Images must be received by us in the condition they were in when delivered to you.
We shall be entitled to recover any direct costs of having to recover any Images from you and may set such costs off against the amount to be re-credited to you. For example, if the cost of recovering the Images from you exceeds the amount paid by you, you will owe us the cost of returning the goods, less the amount you have already paid.
All sums to be re-credited to you in respect of a canceled Order will be re-credited to the same credit/debit card you used to place your Order.
As of 2008, in our change of policies and as a part of our environmental responsibilities, with every effort in reducing our carbon footprint, we no longer send out speculative paper mail shots. We now once a month send an e-newsletter via our appointed third party. We take every care to manage and monitor this e-newsletter email list and provide via a genuine unsubscribe service. In obtaining your email address we have contacted at some point in the past your organisation asking to speak to you or the marketing / press officer or the person whom would deal with photography / photographers, the individual we made contact with has supplied us your email address, with the intention to send you an email.
Under the data protection act 1998, section 7 (1), you are within your legal rights to see the information we may hold about you.
RIGHT FOR YOU TO RETURN IMAGES
If the Images we deliver (whether electronically and/or by way of physical copies) are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, you must notify us in writing via our online form of the problem within seven (7) Working Days of the delivery of the Images in question.
It is your responsibility to inspect the Images for any damage or defect within seven (7) Working Days of delivery.
If you notify a problem to us, our only obligation will be, at our option;
to make good any shortage or incorrect delivery of Images, or
to replace or repair any Images that are damaged or defective, or
to refund to you the amount paid by you for the Images in question. All sums to be re-credited to you will be re-credited to the same credit/debit card you used to place your Order.
